Harbor Software LLC (“Harbor Software,” “we,” “our,” or “us”) respects the privacy of visitors to our website and clients who engage our services. This Privacy Policy explains what information we collect, how we use it, who we share it with, and what rights you have.

Harbor Software is a US-registered limited liability company providing custom software development and AI automation services to business clients. We do not market to or knowingly collect personal data from consumers for personal, family, or household purposes.

We collect this through standard web server logs and analytics tools.

2.3 Information from Third Parties

• Referral partners who introduce potential clients to us, with your consent

Service providers. We use third-party vendors to operate our business, including cloud hosting, email, payment processing (Stripe), accounting, and analytics. These vendors receive only the information they need to perform their function and are contractually required to protect it.

Subcontractors working on your project. If your engagement requires specialist support (for example, a designer or machine learning engineer), we may share relevant project information with vetted subcontractors under confidentiality obligations.

Legal and regulatory requirements. We disclose information when required by law, court order, valid subpoena, or to respond to a government request. We also disclose information where necessary to prevent fraud, protect our rights, or protect the safety of any person.

Business transfers. If Harbor Software is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We will notify affected clients before any such transfer.

The following categories of third-party services may process limited personal information on our behalf:

• Payments: Stripe (billing, subscriptions, and payment card processing)
• Website and hosting: Cloud infrastructure providers for site and email

Each provider operates under its own privacy policy. Payment card data is submitted directly to Stripe and is not stored on Harbor Software systems.

We use a minimal set of cookies and similar technologies. These include strictly necessary cookies that keep the site functional and, where applicable, analytics cookies that help us understand aggregate site usage. You can manage cookies through your browser settings. Disabling some cookies may affect site functionality.

We do not use cross-site advertising trackers.

7. Data Retention

We retain personal information for as long as necessary to provide services and fulfill the purposes outlined in this policy, or as required by law. Specifically:

• Active client records: retained for the duration of the engagement
• Financial and tax records: retained for at least seven years after the end of the relevant tax year, as required by US law
• Contract and communication records: retained for at least four years after the engagement ends, for legal and audit purposes
• Website visitor logs: retained for up to 24 months in aggregated form

When retention is no longer required, we delete or anonymize the information.

8. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. Security measures include encrypted transmission, access controls, least-privilege permissions, and vendor security reviews.

No system is completely secure. While we work to protect your information, we cannot guarantee absolute security.

9. International Transfers

Harbor Software operates from the United States. Our service providers and subcontractors may be located in other countries. If you are based outside the United States, your information may be transferred to, stored in, and processed in the United States and other jurisdictions with different data protection standards than your home country.

Where required, we rely on appropriate transfer mechanisms, such as Standard Contractual Clauses approved by the European Commission and the UK equivalent, to protect international transfers.

10. Your Rights

Depending on your location, you may have the following rights regarding your personal information:

For residents of the European Economic Area and the United Kingdom (GDPR and UK GDPR): right of access, right to rectification, right to erasure, right to restrict processing, right to data portability, right to object, and right to withdraw consent. You also have the right to lodge a complaint with a supervisory authority.

For residents of California (CCPA and CPRA): right to know what personal information we collect, right to delete personal information, right to correct inaccurate information, right to opt out of the sale or sharing of personal information (we do not sell or share personal information as defined under California law), and right to non-discrimination for exercising these rights.

For all users: you can contact us at any time to ask about, update, or request deletion of your personal information.

To exercise any right, email privacy@harborsoftware.com from the email address associated with your records. We will respond within the time frame required by applicable law, typically within 30 days. We may need to verify your identity before processing certain requests.

11. Children’s Privacy

Harbor Software provides business-to-business services. Our website and services are not directed to children under 16, and we do not knowingly collect personal information from children. If you believe we have collected information from a child, contact us and we will delete it promptly.

12. Do Not Track

Some browsers send a “Do Not Track” signal. Because there is no common industry standard for how to respond to this signal, our site does not currently respond to Do Not Track requests. We minimize tracking regardless of signal.

13. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date at the top. Material changes will be communicated to active clients by email. Continued use of our services after changes take effect constitutes acceptance of the revised policy.
